Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, software, hardware designs, applications, and services (collectively, the “Services”) provided by LVMLabs (“we,” “us,” or “our”). By using the Services associated, you agree to be bound by these Terms.

By accessing or using any part of the Services, you agree to comply with and be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Use of Services and Intellectual Property

License: Unless otherwise stated, all code, schematics, documentation, and original content are the intellectual property of LVMLabs. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal or educational purposes, subject to any specific open-source licenses (e.g., MIT, GPL, or CERN-OHL) attached to individual projects, listed on the project page.
Restrictions: You may not use the Services for any illegal purposes, to infringe upon the rights of others, or to interfere with the security and proper functioning of the Services.

3. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LVMLABS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT:

  1. THE SERVICES WILL MEET YOUR REQUIREMENTS.
  2. THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
  3. THE RESULTS OBTAINED FROM THE USE OF HARDWARE DESIGNS OR SOFTWARE WILL BE ACCURATE, RELIABLE, OR SAFE FOR ANY SPECIFIC APPLICATION.

4. Subsidiaries

CONSENT TO THESE TERMS IS SPECIFIC TO THE SERVICES PROVIDED BY LVMLABS. THIS CONSENT DOES NOT EXTEND AUTOMATICALLY TO ANY SUBSIDIARY, AFFILIATE, OR THIRD-PARTY PARTNER. USERS ARE RESPONSIBLE FOR REVIEWING AND AGREEING TO THE SPECIFIC TERMS OF SERVICE FOR EACH INDEPENDENT ENTITY THEY INTERACT WITH THROUGH OR ALONGSIDE THE SERVICES.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LVMLABS, ITS CONTRIBUTORS, OR ITS FISCAL SPONSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, OR ANY PROPERTY DAMAGE (INCLUDING HARDWARE FAILURE OR FIRE) RESULTING FROM THE USE OR INABILITY TO USE THE SERVICES.

6. Indemnification

You agree to indemnify and hold harmless LVMLabs and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

7. Modifications to Services and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. We may also update these Terms from time to time. Continued use of the Services after such changes constitutes your acceptance of the new Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Santa Clara County, California.
